1. Parties

This agreement is between Thorb (“we”) and you, as a registered user of Thorb.

2. Eligibility

You must be 18 or older, or have a guardian’s consent. The region you choose at registration (Mainland China or Overseas) decides your currency, login method and allowed shipping addresses, and cannot be changed afterwards.

3. Account

You log in with a verification code. Keep your phone or email secure; you are responsible for activity on your account. If it is misused, contact us at bd@thorb.com at once.

4. The service

We sell the components needed to replicate open-source hardware projects, and the following paid services: SMT assembly (only offered by kits whose PCB needs it), assembly, firmware flashing and whole-unit testing. Prices and stock are those shown on the page when you order.

5. Acceptable use

No unlawful use, no interfering with the system, no bulk or automated ordering for profit, no impersonation.

6. Intellectual property

Copyright and licences of the open-source projects behind the kits belong to their owners; see “Third-party Licences and Trademarks”. The site’s own pages and text belong to Thorb.

7. Development version

Thorb is currently a development version (a trial run). We sell kits for rebuilding open-source hardware, not mass-produced finished products. Pictures, specifications and descriptions on the site are for reference; what counts is the item you receive and the project itself. The following are normal and are not a quality problem, nor a reason for a return or refund:

  • 3D-printed parts (case, keycaps and so on) are printed on our own printers. They may have burrs, layer lines or stringing, a rough finish and dimensional tolerances, and some may need sanding before they fit.
  • The baseboard PCB is made by us in small batches. Its edges, silkscreen and solder mask may have minor flaws.
  • Soldering service is done by hand. Joints may not look neat and may carry flux residue.
  • Components come from third-party sources. Batches differ, so appearance, colour and markings may differ from the pictures.
  • Screens may show the slight backlight bleed, colour shift and rare bright pixels that are inherent to IPS panels.
  • Mechanical switches, joysticks and speakers vary from unit to unit in feel and sound.
  • Firmware and software are maintained by the upstream project. After an upstream update the behaviour may differ from what the page says, and we do not promise compatibility with newer versions.
  • Guides and tutorials are taken from upstream material and may differ from the real item.
  • If a component is out of stock we may substitute an equivalent part.
  • A kit takes some hands-on skill. Damage from your own assembly or modification is not covered by after-sales.
  • Specifications and features may change as the project is updated.

8. Limitation of liability

To the extent the law allows, our liability for any loss arising from the goods and services on this site is limited to the amount you actually paid for the order concerned, and we are not liable for indirect loss or loss of profit. Liability that the law does not allow to be excluded (for example personal injury caused by intent or gross negligence) is not limited by this clause.

9. Changes and termination

We may update this agreement; its version number then goes up and we ask you to accept it again. You may delete your account at any time.

10. Governing law and disputes

This agreement is governed by the laws of the People’s Republic of China (excluding the laws of Hong Kong, Macau and Taiwan). Disputes are first settled by friendly negotiation; failing that, either side may sue in a court with jurisdiction.
